Executive contract vs. employment contract: key differences
A director or board member performs their office under an agreement on the performance of office (AOP), not an employment contract: the Czech Labour Code does not apply to them. The AOP can be (un)paid, and sets the amount of remuneration, resignation terms, non-compete and the method of liability for damage. The key advantage: removal from office is quick and without a notice period. A correctly set up AOP protects the business when a key manager leaves and sets clear rules for both sides.
