A valid non-compete clause: statutory conditions
A non-compete clause must meet strict statutory conditions (Section 310 of the Czech Labour Code): it must be agreed in writing, cannot last longer than one year after the end of employment, the employer must pay reasonable financial compensation (at least 50% of average monthly earnings for each month it applies), and it must define the scope of work or commodities covered. A clause covering an entire industry or without financial compensation is invalid. I will prepare a clause that is valid and enforceable.
