How to write an effective criminal complaint
A criminal complaint filed without legal help is often incomplete or too vague, which leads to it being shelved without an investigation being opened. A good criminal complaint accurately describes the facts with a timeline, identifies the perpetrator and witnesses, refers to documentary evidence, and proposes a legal classification of the act. The police must review the matter within the statutory periods under Section 159 of the Criminal Procedure Code (2 months, 3 months, or 6 months depending on the seriousness of the case); these are directory time limits. A decision to shelve the case can be challenged with a complaint and referred to the public prosecutor for review.
