What I will handle for you

A lawsuit is an effective collection tool if the debtor does not respond to the pre-action letter. A payment order can be issued without a hearing, typically within weeks. If successful, the other party reimburses your litigation costs including the court fee.

  • Preparing and filing a lawsuit for payment
  • Application for a payment order (no cap on the debt value)
  • Electronic payment order (EPR)
  • Standard court proceedings for complex cases
  • Representation at the court hearing
  • Tracking progress and reporting on the outcome

Payment order or lawsuit: how to choose the right approach

A payment order (Section 172 of the Czech Code of Civil Procedure, o.s.ř.) is the fastest and cheapest court tool for undisputed debts. The court issues it based on the lawsuit and the attached evidence without a hearing, typically within weeks to a month (the law sets no deadline). The debtor has 15 days to file an objection. If they do not object, it becomes final and enforcement can begin. If they do object, the case moves to standard proceedings. An electronic payment order (EPR) is even faster; the CZK 1,000,000 threshold applied to it historically, but the current Code of Civil Procedure sets no value cap for a payment order. In more complex factual situations, I recommend a standard lawsuit with full legal argumentation.
