Q: Is the Ministry of Justice's table binding?

No. It is an advisory document that helps unify how courts decide these cases. The court always assesses individually the paying parent's financial situation, the child's justified needs, the extent of care provided by both parents, and any other maintenance obligations. The table is, however, a good starting point for negotiation and for estimating what is realistic in court.

Q: What if the paying parent hides their income or works off the books?

The court can rely on the so-called potential income principle: it assesses the income the parent could achieve given their skills and abilities. For self-employed parents who fail to document their income, the court can rely on a statutory presumption. These are exactly the situations where a lawyer can help.

Q: Can child support be increased or decreased retroactively?

Yes, when there is a substantial change in circumstances (a change in income, new maintenance obligations, the child starting secondary or higher education). Child support for minor children can also be awarded retroactively, up to 3 years back.

Q: The other parent isn't paying child support. What can I do?

Unpaid child support can be enforced. Failing to pay for longer than 4 months, if this exposes the child to a risk of hardship, is the criminal offense of failure to pay child support (Section 196 of the Criminal Code, as effective from 1 January 2026). How courts determine child support

Child support is not set at a fixed amount by law. The Czech Civil Code states that a child has the right to the same standard of living as their parents, so the court examines three areas: the paying parent’s abilities and capabilities (actual and potential income), the child’s justified needs (age, health, interests, schooling), and the extent of personal care provided by each parent.

The Ministry of Justice’s advisory table from 2022 gives both courts and parents a shared starting point: a share of net income based on the child’s age and the number of maintenance obligations.
