How divorce works in practice, and how long it takes
An uncontested divorce (Section 757 of the Czech Civil Code) is possible when both spouses agree on the divorce itself, on child custody, on property and on housing, and the court simply approves these agreements. Proceedings on the divorce and on the arrangements for minor children are held together in a single proceeding, and with well-prepared agreements the court can often resolve the whole matter within weeks to a few months. A contested divorce without agreement can drag on for many months or even years, especially where there are minor children. The key is preparing a solid agreement on custody, child support and marital property before filing. Step by step: how a divorce works once you contact me
First we go through the agreement on child custody and residence, if you have minor children the court will not grant the divorce without it. At the same time we prepare a written agreement on dividing marital property (SJM) and on housing after the divorce; both agreements need officially certified signatures of both spouses. Only then do I draft and file the divorce petition with the competent court, attaching the marriage certificate, the children's birth certificates and all agreements. After the court fee is paid (CZK 2,000 for an uncontested divorce, CZK 5,000 for a contested one) a hearing follows; for an uncontested divorce it tends to be short, the court simply verifies the conditions and approves the agreements. The marriage is dissolved only on the day the judgment becomes final, not on the day of the hearing.
Divorce in Prague: situations I see most often
In practice I see two situations most often where a divorce slides from uncontested to contested. The first is disagreement over custody, typically when one parent wants to move the child outside Prague or abroad. The second is a dispute over a property held in marital property, common with higher-value Prague flats and houses, where the spouses disagree on its value or on who will keep living there. Both can often be avoided if you prepare the agreement in advance and have it checked before filing.
What to prepare for the first consultation
You will speed up the consultation by preparing in advance your marriage certificate, the children's birth certificates, an overview of joint and separately owned assets and debts (property, mortgage, accounts, vehicles), and an idea of how you would like custody and child support arranged. If you already have some preliminary understanding with your spouse, even an informal one, bring it, it makes it easier for me to draft the agreements so the court has no reason to reject them.
