Dividing marital property tends to be the source of the most heated disputes in divorce proceedings. The most common issues concern real estate (who keeps the flat, how to compensate the other spouse), mortgage loans (refinancing, transfer), business interests and pension savings. Crucially, the division must take place within 3 years of the divorce, otherwise a statutory presumption applies that is disadvantageous to both spouses. Reaching an agreement is the best way to avoid a lengthy court dispute.
