What to watch out for when gifting property
Gifting property is a popular way of transferring assets between generations, but it raises a number of legal questions that many people overlook. As a graduate of the Faculty of Law of Charles University specializing in property rights, I know that the most common mistake is gifting property without securing the donor’s rights, that is, without a right of residence or a right to live there for life. The donor can then lose their home. It is equally important to consider the tax implications and any offsetting of the gift against an inheritance share. Every gift agreement I draft includes suitable protective clauses and reflects the wishes of both parties.
