Being given notice by your employer is a stressful experience. However, many notices are invalid: the employer did not meet the formal requirements or did not have a statutory ground. Even a valid notice does not have to be the end of the story.

What to do after receiving a notice of termination, step by step

As soon as you receive a notice, check the following: is it in writing? Does it state a statutory ground? Was the correct procedure followed (consultation with a trade union, if one exists)? Are you in a protected period? If the notice looks questionable, you must file a lawsuit challenging it as invalid within 2 months of the day the employment was supposed to end (from the expiry of the notice period), not from the day the notice was delivered; this deadline is preclusive and cannot be extended. Even a valid notice does not mean you lose all your entitlements: you have the right to severance pay (1 to 3 months' salary) in the case of redundancy, to unused holiday leave, and to a correctly calculated severance amount.
